(Oral) Order dated 30.01.2023, says as under:- "By way of present petition filed under Article 226 of the Constitution of India, petitioner is seeking a writ in the nature of Habeas Corpus for releasing of her daughter Ekamdeep Kaur (detenue), aged 21⁄2 years, from the illegal custody of respondents No.4 to 9.

Counsel for the petitioner submits that there is matrimonial dispute between the petitioner and respondent No.4, and they are living separately from each other. For the purpose of maintainability of the present petition, counsel relies upon the judgment of this Court in case Ajay Bansal Vs. State of Punjab and another, 2013(3) RCR (Criminal) 338.

Today, on the very outset, counsel for the petitioner states that after filing of the present petition, custody of the detained child i.e. 'Ekamdeep Kaur', aged 21⁄2 years, has been handed-over to the petitioner. Hence, relief claimed in the present petition does not survive. Dismissed as infructuous.
