(ORAL) The petitioner herein has sought the relief of anticipatory bail in the criminal case arising out of the FIR bearing No.103 dated 28.06.2013 registered at Police Station Nagina District Nuh Mewat, under Section 379 IPC.
Learned State counsel, on the instructions from HC Suresh Kumar from the above-said Police Station, apprises the Court that till date, the petitioner has never joined in the investigation and rather, he had been declared proclaimed offender in this case on 28.01.2014 and thus, he has been evading his arrest for the last more than eight years. It has been held by the Apex Court in State of Madhya Pradesh vs. Pradeep Sharma 2014(2) SCC 171 that "if the accused is SEEMA SHARMA 2022.02.08 17:02 I attest to the accuracy and authenticity of this document

absconding and has been declared proclaimed offender in terms of Section 82 of Criminal Procedure Code, he should not be granted anticipatory bail".
However, at this stage, learned counsel for the petitioner seeks permission to withdraw the instant petition while submitting that it has become infructuous.
Learned State counsel has no objection for the withdrawal of the present petition.
