The respondent-Rajinder Kaur is present in the Court along with her learned counsel. She fairly admits that the tenanted premises is lying locked for quite some time. It has been noticed that the landlord had sought the eviction of the tenant, apart from the other grounds, on the ground of cease to occupy the said premises. On the direction of this Court, the Rent Controller has already submitted a report to the effect that the tenanted premises is lying locked. The Rent Controller has also stated that as per the statements recorded, the school is lying locked for the past 2/3 years. 2.

Keeping in view the aforesaid admitted position, it is considered appropriate to remit back the matter to the Rent Controller for re-decision of the entire case. The learned counsel representing the parties have no objection thereto.

Consequently, the present revision petition is allowed and the orders under challenge are set aside. As the eviction petition was filed on 15.09.2011, therefore, the Rent Controller is being requested to re-decide the matter on all the grounds within a period of two months, positively. The parties through their learned counsel are directed to appear before the Rent Controller on 09.11.2021. The Rent Controller is requested to take up the case on a day-to-day basis so as to ensure the speedy disposal. 4.

The miscellaneous application(s) pending, if any, shall stand disposed of.
