AMIT RAWAL J. (Oral) Both the learned Senior Counsel made a joint statement that Memorandum of Understanding regarding the compromise has been entered into between the parties. One of the appeal pending before the Sessions Judge arising out of the proceedings initiated under Section 138 of the Negotiable Instruments Act, had been withdrawn by respondent No.1. It is the only suit which is to be withdrawn and the present revision petition is arising out of the dismissal of the application filed under Order 39 Rules 1 and 2 of the Code of Civil Procedure.
