Revision-petitioner and learned counsel for respondent under the instructions of Mr. Vijay Kumar Bhatia, General Power of Attorney of respondent submit that the matter has since been amicably settled and under the settlement, revision-petitioner has agreed to purchase the disputed property for `68 lakhs. Out of the amount of `68 lakh, a cheuqe bearing no. 096583 dated 16.03.2018 amounting to `5 lakh in the name of respondent has been handed over to Vijay Kumar Bhatia, GPA of respondent, in Court. Photocopy of the cheque has been placed on file. Sale deed will be got executed within four months. Parties will submit detailed terms of compromise before the Executing Court. Parties have also agreed that amount of mesne profits, which has been deposited by the revision petitioner and is lying with the Executing Court be refunded to revision petition. CR No. 7910 of 2017 -2revision-petitioner within a period of four months from today, respondent will be at liberty to get the ejectment order executed through Court. In view of above settlement, revision-petitioner seeks permission to withdraw the instant petition.
Dismissed as withdrawn in view of the terms of aforesaid settlement. However, parties will submit detailed compromise before the Executing Court within a period of two weeks.
