(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.356 dated 10.12.2018 under Sections 307, 186, 353 IPC and Sections 25, 54, 59 of NDPS Act registered at Police Station City Hansi. Learned counsel for the petitioner inter alia would contend that the petitioner has falsely been implicated in the said matter as no offence under Section 307 IPC is made out against the petitioner. In fact, the police officials fired shot on right leg of the petitioner and no police official received any injury. The petitioner is in custody since 10.12.2018. Investigation is complete and the challan stands presented. The trial is likely to take some time to conclude and therefore, prays for concession of bail to the petitioner.

Learned counsel appearing for the respondent-State opposes the regular bail by contending that the petitioner herein is a prized crook and when the police party tried to nab him on the basis of secret information, he fired bullet shots upon the police party from his illegal weapon. CRM-M No.5952 of 2021 (O&M) -2I have heard learned counsel for the parties. Since the investigation is complete and the challan has already been presented and no recovery is to be effected from the petitioner coupled with the fact that the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
