AMIT RAWAL J. (Oral) The present revision petition is against the impugned order dated 19.07.2016, whereby, an application filed under Order 7 Rule 11 CPC for rejection of the plaint, has been allowed.

As per the provisions of Section 2(2) CPC, any application decided thereto, shall be treated as decree, in essence, it is appealable. At this stage, Mr. Gurminder Singh, leaned Senior Counsel seeks liberty of this Court for withdrawal of the present revision petition with liberty to file an appeal and time spent here in this Court be also condoned. In view of the aforementioned, the present revision petition is ordered to be dismissed as withdrawn with the liberty as prayed for. In case, any appeal is filed within a period of two weeks from today, the period spent in the present Court in pursuing the remedy by filing the revision petition, shall be condoned.
