(Oral) The appellant has filed the instant appeal against the judgment and decree dated 13.02.2015 passed by the learned trial Court whereby the suit for mandatory injunction filed by the plaintiffs/respondents has been partly decreed and the judgment and decree dated 15.01.2016, passed by the learned Appellate Court whereby the appeal preferred by the appellant against the aforesaid judgment and decree dated 13.02.2015, has been upheld. Learned counsel for the appellant wishes to withdraw the present appeal.
