*** Ritu Bahri, J. (Oral) By way of filing present writ petition, petitioners are seeking issuance of direction to the respondents to release the amount due to the petitioners, which is due as per information furnished by the respondents from the funds that are being received.

At the very outset, learned counsel for the petitioners has stated that the position of law in this regard is duly settled by this Court in the matter reported as M/s Dharam Pal Contractors Hot Mix Plants Danewala and others vs. State of Punjab passed in CWP No. 14621-2014, decided on 05.11.2014, wherein more than 100 cases were decided directing the State Government to make the payment under identical situation. In the present case, the petitioners are individuals/sole proprietorship's that are enlisted with Municipal Corporation Faridabad and to whom various works of different nature were allotted through different work orders. The amount of more than Rs.65 crores is pending and the petitioners are registered contractors in the Municipal Corporation Faridabad for the year 2015-16 (P-1). CWP-2987 of 2021 Corporation Faridabad have also got registered an association by the name of Faridabad Nagar Nigam Contractors Welfare Association, NIT Faridabad registered vide Registration No. DIC/FBD/4 dated 13.08.2003. The details of the amount due to the petitioners have been annexed with the petition as Annexure P-2 to P-63.

On asking of the Court, Mr. Hitesh Pandit, Addl.A.G. Haryana accepts notice on behalf of respondent-State. Let copy of the petition be sent to learned State counsel by learned counsel for the petitioner by today itself. In view of the above factual position, the present petition stands disposed of by giving direction to respondent No 3 to decide the claim of the petitioners by passing speaking order in view of M/s Dharam Pal's case (supra), within a period of four weeks, from the date of receipt of certified copy of this order. In case the petitioners are found entitled, the payment be released within the next six weeks.
