Learned counsel for the respondents No. 1 to 6 has pointed out that all the persons who have not been served are actually co-tenants with the petitioner and this is just a further device to delay the eviction petition.

Counsel for the petitioner and counsel for respondents No. 7 and 8 state that there is no such intention and that on the next date all the co-tenants of the petitioner would be represented by Mr. Divanshu Jain, Advocate. Adjourned to 15.3.2018.

CR-798-2018 (O&M) counsel. It has been agreed that all the persons who were proceeded ex parte before the Courts below would be permitted to join the trial but would not be entitled to re-open the things which have already happened. It has been further agreed that one effective opportunity would be granted to the petitioner to cross examine PW-1. The revision stands disposed of in the above terms. Since the main case has been decided, the pending C.M, if any, also stand disposed of.
