**** JAISHREE THAKUR, J. (ORAL) Instant writ petition is filed to challenge the selection that had been made for the post of Block Development and Panchayat Officer by contending that there was violation of the judgment of the Hon'ble Supreme Court rendered in Ashok @ Somanna Gonoda and another vs. State of Karnataka, 1992(1) R.S.J. 99 whereby more than 28% marks had been allocated for the viva voce test.

A written statement came to be filed wherein a plea had been taken that subsequent to the interview held that the appointment letters had been issued as far back on 11.07.1995.

Faced with this, learned counsel for the petitioner had sought time to amend the writ petition and implead the selected candidates. As per the office noting, the selected candidates have not been served for want of correct addresses. Learned counsel for the petitioner submits that he has not been able to contact the petitioner. CWP No.11436 of 1995 -2This Court is of the opinion that without serving the selected candidates who have been arrayed as party - respondents in the writ petition, the writ petition deserves to be dismissed on account of non-joining of necessary parties.

At this stage, Mr. Mahesh Gupta seeks permission of this Court to withdraw this writ petition with liberty to challenge the said selection in case the petitioner does contact him to seek revival of the writ petition within a period of three months, if so required.
