Maghar Dass v. Benat Singh & ANR.
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH.
C.R. No. 8395 of 2016 Date of Decision: April 06, 2017.
Maghar Dass ....Petitioner
Versus
Beant Singh and another .....Respondents
CORAM:
HON'BLE MR.JUSTICE RAJAN GUPTA
Present:
Mr. H.S.Saggu, Advocate, for the petitioner. Rajan Gupta, J (Oral) Present revision is directed against the order passed by Additional Civil Judge (Sr. Div.), Nabha whereby respondent No.2 has been impleaded as defendant in the suit. While deciding the application, trial court observed that question of possession and demarcation of land was involved in this case and land of plaintiff and applicant are adjoining to each other, it would be in the interests of justice to allow the application under Order 1 Rule 10 CPC. Admittedly, thereafter petitioner filed replication to the reply submitted by the newly added defendant. Suit was instituted way back in the year 2013. It has been pending since then due to one application or the other coming before the court below. This court feels that no further delay can be brooked though the order under challenge is upheld. Petition is, thus, dismissed. However, It is directed that the suit be decided expeditiously preferably within a period of six months. (Rajan Gupta) Judge April 06, 2017.
