RITU BAHRI J. (Oral) This petition under Article 227 of the Constitution of India is for setting aside order 26.09.2017 passed by learned Civil Judge (Jr. Divn), Ludhiana vide which the application filed by defendant No. 1 has been dismissed and the cross objection of P.W.1 Gulzar Kaur has been treated to be NIL.

A bare perusal of the impugned order shows that Gulzar Kaur is a very old age lady and appeared before this Court on wheelchair from Chandigarh.

Learned counsel for the petitioner has informed the Court that the plaintiff's evidence is still going on and submits that the cross examination of Gulzar Kaur is very much necessary for just decision of the case.

In view of the above, order 26.09.2017 passed by learned Civil Judge (Jr. Divn), Ludhiana and the revision petition is allowed. The petitioner is granted one opportunity to make an application for appointment of Local Commissioner before the Court below for cross examination of Gaurav Arora 2017.11.24 14:55 I attest to the accuracy and integrity of this document Chandigarh
