The petitioner has filed the present petition under Section 438 Cr.P.C., for grant of anticipatory bail in case FIR No. 130 dated 23.10.2022 registered under Sections 342, 384, 506, 148, 149, 364-A and 386 IPC and Sections 25 and 27 of the Arms Act at Police Station Dirba, District Sangrur.

As per prosecution version, on 20.10.2022, the petitioner along with his co-accused had abducted complainant Munish Kumar and obtained a huge amount of Rs.4,20,000/- from the complainant by putting him under feat of death and also threatened him to arrange another amount of Rs.80,000/-.

Learned counsel for the petitioner, inter alia, contends that petitioner has falsely been implicated in the instant case. There is no specific allegation against the petitioner. Learned counsel further contends that the matter has now been compromised between the parties as per compromise deed and affidavit both dated 17.12.2022 (Annexures P-3 and P-4, respectively). CRM-M-5184-2023 -2compromise have also been recorded by the trial Court, in terms of order dated 23.01.2023, passed by a co-ordinate Bench of this Court in CRMM-620-2023. The petitioner is ready and willing to join the investigation. Learned counsel appearing for the complainant has not disputed the factum of compromise effected between the parties and submits that he has no objection in case the present petition is allowed and petitioner may be granted the concession of anticipatory bail. Keeping in view the facts and circumstances of the case and also the fact that the matter has already been compromised between the parties, but without commenting upon the merits of the case, the present petition for anticipatory bail is allowed and in the event of arrest, the petitioner shall be released on bail subject to furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. The petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) of the Cr.P.C.
