During the pendency of the execution petition, the petitioner (judgment debtor No.4) was proceeded against ex parte. Admittedly, the execution petition is pending. A party, who is proceeded against ex parte on a particular date, has a right to join the proceedings and to contest the matter. Admittedly, the decree against the judgment debtor has become final. 2.

In such circumstances, the application for setting aside the ex parte proceedings are not required to be filed. 3.

With the observations made above, the present revision petition is disposed of.
