The prayer in the present petition is for quashing of FIR No. 120 dated 19.08.2019 registered under Section 306 IPC at Police Station Badhni Kalan, District Moga (Annexure P-1), along with all consequential proceedings arising therefrom.

Learned counsel for the petitioner contends that the name of the petitioner is neither mentioned in the FIR nor in the suicide note. It is submitted that his implication is based only on a supplementary statement of the complainant and even in the said statement, no specific allegations have been levelled against him. Therefore, the FIR qua the present petitioner is liable to be quashed.

Learned State counsel, on the other hand, submits that 4 out of 33 prosecution witnesses have already been examined and the petitioner SHUBHAM 2026.02.16 09:49 I attest to the accuracy and authenticity of this document/order -1-

CRM-M-6429-2021 may raise all the grounds taken in the present petition before the learned trial Court at the appropriate stage.

Admittedly, the trial is in progress and some of the prosecution witnesses have already been examined. Therefore, at this stage, I deem it appropriate to dispose of the present petition with a direction to the trial Court to consider all the grounds raised by the petitioner before this Court at the appropriate stage, in accordance with law. 6.
