Learned counsel for the petitioners submits that the regular first appeal filed against the award of the reference Court was disposed of with direction to the respondents to comply with the directions as given by the Apex Court in case of HSIIDC Vs. Pran Sukh (2010) 11 SCC 175. He, however, conceded that in compliance of that order, petitioners have already supplied their bank account numbers and now only payment is to be released.

The remedy of filing of the execution of order dated 13.12.2018 passed in RFA No.3223 of 2009 is available to the petitioners. The purpose of filing of this petition is to execute the order dated 13.12.2018 and separate remedy is available to petitioners in this regard. There is no explanation as to why the petitioners have not availed the remedy of filing the execution petition. Consequently, this petition is disposed of with liberty to the petitioners to avail other legal remedies available to them. ( SURINDER GUPTA ) February 03, 2020 JUDGE Sachin M.
