Jattana, Advocate for the respondent. *** ANIL KSHETARPAL, J (Oral) The hearing of the case was held through video conferencing on account of restricted functioning of the Courts. This application has been filed by the wife to transfer the petition, bearing No.DMC/590/2020 (Guriqbal Singh vs. Simranpreet Kaur) filed under Section 9 of the Hindu Marriage Act, 1955, pending in the Court of learned Additional Principal Judge, Family Court, Bathinda, to the Court of competent jurisdiction at Sirsa.

The petitioner claims that the distance between Bathinda and Sirsa is more than 100 kms. and the respondent is already defending two litigations at Sirsa i.e. proceedings under Section 125 Cr.P.C. as well as proceedings under the Protection of Women from Domestic Violence Act, 2005.

TA-150-2021 (O&M) DMC/590/2020 (Guriqbal Singh vs. Simranpreet Kaur), filed under Section 9 of the Hindu Marriage Act, 1955, pending in the Court of learned Additional Principal Judge, Family Court, Bathinda, are ordered to be transferred to the Court of competent jurisdiction at Sirsa. The transferor Court is requested to remit the case file to the transferee Court forthwith. The parties are directed to appear before the District Judge, Sirsa, on 04.10.2021 who shall either decide the matter himself or assign it to the Court of competent jurisdiction at Sirsa.

All the pending miscellaneous application(s), if any, are also disposed of.
