(Oral) This petition has been filed seeking a writ of mandamus directing the respondents to take a decision on the letter dated 24.01.2023, Annexure P-17, written by the District Education Officer, Kurukshetra to respondent no.2 for sanctioning the period of child care leave of the petitioner, i.e., from 08.09.2019 to 14.04.2020 by way of regularizing the same period instead of creating a unnecessary gap in the service record and to pay the salary of the same period.

Learned counsel for the petitioner submits that grievance raised herein is pending for appropriate decision before the respondents. At this stage, the petitioner will be satisfied in case respondent No.2 is directed to PAYAL 2024.02.02 11:28 I attest to the accuracy and authenticity of this order/judgment

Ms. Tanushree Gupta, DAG, Haryana, appearing on advance notice, submits that the pending letter/memo shall be decided by respondent No.2 expeditiously.

In view thereof, without going into merits of the case, the petition is disposed of with a direction to respondent No.2/Director, Department of Secondary Education, Haryana, to consider and decide the pending letter/memo dated 24.01.2023, by passing a speaking order in accordance with law, within a period of three months from the date of receiving a certified copy of this order.

In case the order is not passed within the stipulated period, the officer concerned shall pay costs of ₹25,000 to the petitioner.
