The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to the respondents to grant family pension in terms of notification dated 08.10.2021 (Annexure P-6) issued by Government of Punjab. The petitioner is further seeking interest on delayed payment of retiral benefits.

The daughter of the petitioner was working with respondent as Constable and she passed away in harness on 01.07.2012. The respondent released to the petitioner benefit of leave encashment on 12.01.2021 and ex gratia on 18.05.2023.

Mr. B.S. Sidhu, Advocate pointing out para 7 of notification dated 08.10.2021 (Annexure P-6) issued by State of Punjab submits that petitioner is eligible to family pension subject to filing undertaking in Annexure II. The daughter of the petitioner expired in 2012 and aforesaid scheme came into force w.e.f. 08.10.2021. The petitioner is ready to file undertaking in Annexure II. 4.

Mr. Aman Dhir, DAG, Punjab, on instructions from ASI Balbir Singh, submits that the petitioner is supposed to file undertaking in Annexure II Anju Goel 2024.03.12 17:31 I attest to the accuracy and integrity of this document Chandigarh

CWP-1983-2024 2 2024:PHHC:034806  and deposit an amount which she had received from NSDL as total Government contribution and growth thereon along with interest. If the petitioner complies with the said requirement, she would be eligible to family pension. 5.

In the wake of statement of both sides, the petition stands disposed of with liberty to petitioner to comply with requirement of submitting undertaking in Annexure II and deposit amount received from NSDL. On doing so, the Competent Authority would decide her claim in accordance with the policy.
