None for the respondents despite being served. K. KANNAN, J (ORAL) There is no representation on behalf of the parties. I have seen the record and the issue is that PW2-Surinder Singh was being examined in part but was not present. The issue is that some witnesses were not cross examined. Cross examination was treated as Nil. The plea, therefore, is that an opportunity must be given to the petitioner to cross examine the Pws without any let up.
This Court, on the last date of hearing, had directed the petitioner to deposit Rs.15,000/- within three weeks. The amount if not already deposited, the same shall be paid to the plaintiff and case shall be re-opened. The petitioner will be at liberty to cross examine the witnesses. Revision petition is disposed of. Order closing the evidence of Pws with cross examination is re-opened and the petitioner will have liberty of cross examination in the manner directed subject to payment of costs. Allowed in the above terms.
