IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH CRM-M-4315-2020 Decided on : 03.09.2021 Malkiat Singh and another . . . Petitioner(s)
Versus
State of Punjab . . . Respondent(s) CORAM: HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL (Through Video Conferencing) PRESENT: Mr. Deepinder Brar, Advocate for the petitioner(s).
Mr. Amit Mehta, Sr. DAG, Punjab assisted by ASI Mukhtiar Singh.
**** MANJARI NEHRU KAUL, J. (Oral) The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioners, in case FIR No. 0001, dated 02.01.2020, under Sections 498-A, 406, 506 of IPC, registered at Police Station Kulgari, District Ferozepur.
Learned counsel for the petitioners submits that the present FIR is an outcome of matrimonial dispute between the parties. The petitioners are the parents in-law of the complainant's daughter and are living separately from their daughter-in-law. Even the allegation of dowry demand was made after a period of 13 years of the marriage, which on the face of it sounds unrealistic. Further submits that pursuant to order dated 31st January, 2020, passed by this Court, the petitioners have joined investigation. Learned State counsel on instructions from ASI Mukhtiar Singh, states that the petitioners are no longer required for further interrogation. In view of the above, the petition is allowed and interim order dated 31st January, 2020, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
