1. The petitioner has filed this petition seeking grant of regular bail in a case registered against him vide FIR No.9 dated 8.1.2020 under Sections 61 of the Punjab Excise Act and Section 483 IPC at Police Station Bhawanigarh, District Sangrur, wherein it is alleged that he was found in possession of of 600 bottles of illicit liquor on 8.1.2020.
2. At the last date of hearing the learned State counsel had submitted that the petitioner has been involved in four other cases and had sought time to furnish accurate information in this regards. Today reply by way of affidavit of Sh. Gobinder Singh, PPS, Deputy Superintendent of Police, Sub-Division Bhawanigarh District Sangrur has been filed wherein it has been deposed that while the petitioner stands acquitted in three of the cases i.e. FIR No.143 dated 11.10.2010, under Sections 452, 323, 148, 149 IPC, Police Station Dirba, District Sangrur; FIR No.231 dated GAURAV SOROT 2020.03.05 17:26 I attest to the accuracy and integrity of this document
( 2 ) CRM-M-3979-2020 13.11.2012, under Sections 279, 336, 427 IPC & Section 61 of NDPS Act, Police Station Civil Lines District Kaithal & FIR No.249 dated 8.6.2015 under Section 15, 25, 28 & 29-A of NDPS Act, Police Station Pehowa but the trial in respect of FIR No.62 dated 1.4.2017 under Sections 304/34 IPC, Police Station Patran District Patiala is still pending.
3. Keeping in view the aforestated position and the fact that in the present case the petitioner has been behind bars since last two months and recovery already stands effected his further detention will not serve any useful purpose as the conclusion of trial is likely to take some time.
4. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
