Prayer made in the present petition is for promotion to the post of Senior Technical Officer, Class-I on the premise that the petitioner was given the current duty charge on the said post. 2.

Learned State counsel makes a reference to para 3 of the written statement to which there was no replication filed, which reads thus: "3. That in reply to para No.3 of the petition, it is submitted that the case of the petitioner for promotion to the post of Senior Technical officer, Class-I was considered by the Department and an Agenda was placed before the Departmental Promotion Committee for consideration as explained in Para 2 above. However, the Department of Personnel did not agree as the rule according to which the promotion is proposed to be made is not notified rules. It is further stated here that the Government on Administrative grounds transferred the petitioner from Industrial Development Centre, (Engg.)

, Ludhiana to Punjab Test House, Ludhiana, vide order Annexure R-3, there is no mention of giving current duty charge of the posts on which he was transferred, though it was a Class-I post. However, in Para 7 of the instructions dated 14.12.2016 (Annexure P-1), it has been mentioned that unnecessarily delay may not be caused in holding the meeting of the Departmental Promotion Committee. The Government in Para 3 (a)-Amendment, of these instructions (Annexure P-1) has made clear that current duty charge will not be treated as promotion in any case."

In view of the above, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to approach the respondents after the rules are notified.
