**** Manjari Nehru Kaul, J.(Oral) This is the second petition filed under Section 439 Cr.PC for grant of regular bail to the petitioner in case FIR No.261 dated 28.08.2019 under Sections 363, 366-A IPC (Section 376(3) IPC and Section 6 of POCSO Act and Section 3(2)(v) of SC/ST Act, 1989 added later on) registered at Police Station Kunjpura District Karnal. On a pointed query put to learned counsel as to what was the material change in the circumstances subsequent to the withdrawal of previous petition seeking similar relief on 17.08.2021, learned counsel has failed to satisfy this Court qua any material change in the circumstances. Learned State counsel on instructions from PSI Sumit has apprised the Court that the trial is nearing conclusion as 10 out of 19 prosecution witnesses have been examined and only 9 remain to be examined. He further submits that all the material witnesses including the victim have supported the case of the prosecution in its entirety. CRM-M-5820-2022 -2In the circumstances, no ground is made out to extend the concession of bail to the petitioner. Accordingly, present petition stands dismissed.
