The present petition has been filed under Article 226 of the Constitution of India for issuance of a writ in the nature of mandamus directing respondents No.2 and 3 to protect the life and liberty of petitioners at the hands of respondents No.4 to 8. 2.

Learned counsel for the petitioners contends that the wife of petitioner No.2 had died in the year 2017 and petitioner No.1 solemnized marriage with respondent No.4 in the year 2023 and out of this wedlock, one child was born, who is 08 months old and the child is residing with petitioner No.1, however, the petitioner No.1 was tortured by respondent No.4 and was thrown out of the matrimonial house and she is now residing with petitioner No.2 in a live-in relationship but the said relationship is not acceptable to respondents No.4 to 8 and they are threatening the petitioners with dire consequences. CRWP-785-2025 and in this regard, submitted a representation dated 21.01.2025 (Annexure P-5) to respondent No.2 but no action has been taken so far. 3.

Notice of motion to the official respondents only. 4.

Mr. Sandeep Godara, DAG, Punjab, who is present in Court, accepts notice for the official respondents. Learned counsel for the petitioners is directed to supply a copy of complete paper book to learned State counsel during course of the day. 5.

Without commenting on the validity of their relationship and entering upon an exercise to evaluate the evidentiary value of the documents placed on the file, I dispose of this petition with direction to respondent No.2 to decide the representation of the petitioners (Annexure P-5) within a period of one week from the date of receipt of a copy of this order and grant them protection, if there is any threat to their life and liberty in accordance with law. 6.

It is made clear that this order shall not be taken to protect the petitioners from legal action for violation of law, if any committed by them.
