The prayer in the present appeal is to set-aside the judgment of conviction and order of sentence dated 28.11.2008 passed by learned Additional Sessions Judge-III, Bhiwani whereby the appellant was convicted and sentenced for the offence punishable under Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985, in the case stemming from FIR No.372 dated 24.10.2005 registered under Section 20 of the NDPS Act at Police Station Bhiwani. 2.

Learned State counsel, on instructions from SI Prem Kumar, submits that during the pendency of the instant appeal, the appellant had died on 09.06.2019. A copy of the Death Certificate of the appellant has been filed in the Court today, which is taken on record.
