The petitioner is aggrieved that the stay application in the appeal has not been decided and it is being adjourned from time to time for the last one year. In the meanwhile, the decree holder has applied for execution and he will be greatly prejudiced if the decree is put in execution.

Even while directing that the Appellate Court shall consider the stay application immediately, I direct the appellant to pay rent @`2,000/- per month from 01.04.2008 till date within a period of two weeks from the date of receipt of copy of this order to take the benefit of the oder of eviction stayed. The stay will operate till such time as the Appellate Court passes order on the stay application. Interim stay granted shall stand vacated if the amount as directed by this Court now is not paid within the time stipulated.
