*** ANIL KSHETARPAL, J.(Oral) In this case, counsel for the petitioner has chosen to remain absent on the last two hearings. Even today, counsel for the petitioner is not present.
The order under challenge is rejection of the plaint under Order 7 Rule 11 CPC. In execution of the Court decree, property was auctioned and father of the defendant purchased the property on 18.05.1959. The aforesaid Court auction has been challenged by way of a suit, filed on 17.02.2014. The learned trial Court has found that the suit is an abuse of the process of the Court. Apart from being barred by limitation, the suit is otherwise also not maintainable.
In view thereof, there is no scope for interference with the impugned order passed.
Hence this revision petition is dismissed.
