**** RITU BAHRI, J. (Oral) Petitioner/defendant No.4 has come up in revision against order dated 20.07.2017 (Annexure P/5) whereby application for deleting his name from the array of parties had been dismissed. A perusal of the impugned order shows that plaintiff was running a business in the name and style of M/s Shalimar Body Builders at Bye Pass, GT Road, Chaugitti, Jalandhar but due to widening of National Highway No.1 (road) from Bidhipur Railway Crossing, Jalandhar to Panipat, he had suffered loss in business. The suit was filed by the plaintiff for recovery of compensation by way of damages for loss of business suffered by him. In this suit, the defendant No.4/petitioner had submitted that he had no dealing with the widening of road. Therefore, he could not be made party in the present case. The application has been dismissed on the ground that the petitioner could take specific objection in his written statement that he was not necessary party in the present case.
