Petitioners have filed the present petition under Section 528 of BNSS, 2023, for quashing of the FIR No.46, dated 25.06.2010, under Sections 452, 427, 448, 511, 148, 149 of IPC, registered at Police Station City Kharar, District Mohali (Annexure P-1) and all consequential proceedings arising therefrom.

At the outset, learned State counsel appearing on advance notice, submits that in view of the judgment passed by the Hon'ble Division Bench of this Court in Rakesh Das v. State of Haryana and another [CRMM-48043-2023 (O&M)] (Decided on : 12.11.2024) : Law Finder Doc Id # 2663704, partial quashing is not permissible. 3.
Faced with this situation, counsel for the petitioners seeks withdrawal of present petition with liberty to file a fresh and comprehensive petition by impleading all the necessary parties i.e. accused and the complainant(s)/victim(s).
