HARINDER SINGH SIDHU, J Prayer for grant of regular bail in case FIR No. 104 dated 20.11.2021, registered under Sections 22, 61 and 85 of NDPS Act, at Police Station Mallanwala, District Ferozepur.

As per allegations in the FIR, 3000 intoxicant tablets of Lomottil were recovered from one Jagwinder Dass. It is alleged that Jagwinder Dass disclosed that he had bought the tablets from the petitioner. Learned counsel for the petitioner argues that only on the basis of disclosure statement of co-accused, the petitioner has been added as accused in the present case and was taken into custody. No recovery has been effected from the petitioner. It is argued that it is incomprehensible as to how the petitioner could supply the contraband to co-accused when he was already in custody. Other than the disclosure statement of co-accused, there is nothing on record to indicate the involvement of the petitioner with the co-accused. Though there are two other criminal cases registered under the provisions of NDPS Act against the petitioner but he has been acquitted in one of the cases.

CRM-M-5539-2022 #2# Without commenting anything on the merits of the case and also bearing in mind the fact that the trial of the case is not likely to be concluded in near future, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Baltej Singh @ Teji is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. This present petition stands accepted accordingly.
