After arguing at length, counsel for the petitioner seeks permission to withdraw the petition with liberty to raise all the pleas available to him in appropriate proceedings before the Rent Controller. Learned counsel for the petitioner submits that an amount of `4,18,000/- including costs and interest, has already been paid and a sum of `5,16,000/- is outstanding which the petitioner will pay in installments. Learned counsel for the petitioner undertakes to make this payment by 30.04.2017.

CR-8647-2016 -2Following consent order is passed regarding payment of balance amount of rent as assessed by Rent Controller vide order dated 05.05.2016:- "Petitioner will pay 25% of the outstanding amount by 31.01.2017 and remaining 25% each will be paid by the last date of February, March and April, 2017. The last installment including the entire balance payments shall be paid upto 30.04.2017. In the event of payment not being made upto 30.04.2017, it will be taken as nonpayment of rent assessed by the Rent Controller and appropriate order will be passed by the Rent Controller."
