This is revision petition against the order dated 20.09.2016 and 06.12.2016.

Perusal of the orders shows that on 20.09.201, witness Kanta Devi was present since morning till 3.55 p.m. but none appeared on half of revision petitioner till 3.55 p.m. and the Court was constrained to treat her cross-examination as 'Nil'.

The application filed by the revision petitioner was also declined by the Rent Controller to grant further opportunity to crossexamine witness Kanta Devi. Counsel for the revision petitioner submits that the revision petitioner be allowed one opportunity to cross-examine the witness and undertakes to cross-examine her on the given date. CR-8682-2016 -2In view of the submission of counsel for the revision petitioner, this petition is disposed of with direction to the Rent Controller to allow one more opportunity to the revision petitioner to cross-examine Kanta Devi, subject to payment of costs of `5,000/- to witness Kanta Devi by way of demand draft. It is, however, made clear that the witness, if not crossexamined on the given date, no further opportunity will be allowed. ( SURINDER GUPTA ) December 22, 2016.
