Boota Singh Basi and others .............Respondents CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Jasbir Singh,Advocate for the petitioner Jaswant Singh,J.(Oral) Defendants 1 to 4 are in revision assailing the order dated 22.1.2015 (P-3) passed by learned Additional Civil Judge (Senior Division)Roop Nagar whereby their application for issuing a direction to the plaintiff to supply legible and complete copies of the documents, has been disposed of.

It is not in dispute that the respondent/plaintiff is married to defendant no.5 Sharanjit Kaur who is daughter of defendants 1 and 2/ petitioners 1 and 2. They both are stated to be residing separately in USA. Said son-in-law has filed a suit on 13.5.2014 for recovery of Rs.22,91,460/-. Defendants filed an application on 31.7.2014 for a direction to furnish legible copies of all the documents attached with the plaint so that written statement could be filed. The same has been disposed of vide impugned order.

Having heard learned counsel for the petitioners, this Court RAJINDER PRASHAD JOSHI 2015.02.11 11:39 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

CR 874/2015 finds no fault with the impugned order. The trial Court has noticed that legible copies of most of the documents i.e. receipts whereby certain amounts are shown to have been sent through Western Union from USA to India, allegedly received by defendants, have already been supplied to the defendants and qua receipts which are not legible, defendants have been given opportunity to verify the same from the Court file. The Court has further observed that the filing of the written statement cannot be delayed any further. As regards the plea of any possible prejudice, that shall be seen at the time of trial. Dismissed.
