PANKAJ JAIN, J. (ORAL) Ld. State Counsel has filed Status report by way of an affidavit of Assistant Commissioner of Police, Panchkula on behalf of respondent No.3, today in Court, the same is taken on record. 2.
Contents of Para No.3 of the same reads as under :- "3. That in compliance of order dated 07.02.2022 passed by this Hon'ble Court the site of the brick kiln Maha Luxmi Int Udyog, situated in Village, Mauli, District Panchkula was examined on dated 14-02-2022. The petitioner was not found present there but all the detenues from serial number 1 to 27 as mentioned in Para No 2 of the petition were found present there in which 13 detenues were male/female and were major, 14 detenues were minor childrens. On the same day 11 male/female major detenues had gone to their native village Shamli (UP) with their 13 minor Childrens. CRWP No.1150 of 2022 -2child namely Aahil who are living there and they do not want to go anywhere. In this regard statement of Sayrat w/o Mohd Saukeen (present petitioner) Talib, S/o Mohd Saukeen, Naeem S/o Islam, Sabnam w/o Naeem, Saleem S/o Allaudeen, Sehkun w/o Saleem, Harun and his wife Anwari, Abhid S/o Deen Mohmad were recorded. They have stated that they want to go their native village and on 14-02-2022, they had as per their consent gone from the Mahaluxmi Int Udyog, Mauli in a canter bearing No. HR-68-A-2371. They have also stated that they will appear on 17-02-2022 through their counsel. In this regard, matter was discussed with their counsel therefore in this regard, DDE No. 25 dated 14-02-2022 was recorded in the daily diary at Police Post Mauli, Police Station Raipur Rani. Labour Inspector (SOP Team) also visited the site of Mahaluxmi Int Udyog, Mauli on dated 15-02-2022. Museen and his wife Robina stated that petitioner has intentionally mentioned their names in the present petition. There is no any problem to them to live at the Mahaluxmi Int Udyog." 3.
In view of the above, Ld. Counsel for the petitioner admits that the detenues, who were wrongly confined, already stand released and the present petition has been rendered infructuous. 4.
In the circumstances, the present petition stands disposed off as having been rendered infructuous.
