The present revision petition has been filed challenging the order dated 21.02.2017 (Annexure P-5) vide which the application filed by the petitioner herein under Order 1 Rule 10 CPC was dismissed. 2.

Learned counsel for plaintiff-respondent No.1 herein states that he would have no objection if the present revision petition is allowed. 3.

In view of the above, the present revision petition is allowed, and the impugned order dated 21.02.2017 is set aside. Consequently, the application filed by the petitioner herein under Order 1 Rule 10 CPC is allowed.
