In the present petition, the grievance of the petitioner is that the petitioner had competed for the post of Haryana Civil Service (Executive Branch) and other Allied Services under the reserved category of visually handicapped as advertised vide advertisement No. 03/2021 dated 26.02.2021 (Annexure P-1) but the petitioner has not been selected despite the fact that the post in the said category in which the petitioner has competed is still lying vacant.

Learned State counsel on the other hand submits that as per the criteria fixed by the department concerned, a candidate was required to clear the written examination for the post in question and thereafter, the candidates who clear the written examination for the post in question, keeping in view the number of posts advertised, were to be called for interview and in case, the candidate does not secure the minimum marks in the written examination, then the candidature of the said candidate comes to an end at that very stage only.

Learned State counsel further submits that as per his RIYA 2024.04.05 16:11 I attest to the accuracy and integrity of this document

CWP-1884-2023 (O&M) -22024:PHHC:044774 instructions the petitioner has secured 35.25 % marks whereas, the minimum required percentage for clearing the written examination for the post in question was 45 %.

I have heard learned counsel for the parties and have gone through the record with their able assistance, 5.

Once, the criteria has been framed by the respondents for making the selection for the post in question and the said criteria has been followed uni-formally qua all the candidates, the petitioner is also governed by the said criteria and nothing has come on record that the petitioner has secured the minimum 45 % in the written examination for the post in question so as to qualify the written examination so as to proceed further in the selection process, hence, the petitioner could not claim further participation in the selection process for the post in question. 6.

As per the respondents, the petitioner has only secured 35.25 % marks in the written examination, whereas, in order to clear the written examination for the post in question at least 45 % marks were to be required. 7.

Keeping in view the above facts and circumstances recorded herein above, no ground is made out for any interference by this Court in the present petition, hence, the present petition stands dismissed. 8.

Pending civil miscellaneous application, if any, stands disposed of.
