Petitioner Sonu Kamboj has filed instant second petition under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail in FIR No.8 dated 19.01.2025 under Sections 64 (2) (m), 78 (1), 351 (3) of Bharatiya Nyaya Sanhita, 2023 and Section 67 (A) IT Act, 2000 and Section 6 of Indecent Representation of Woman (Prohibition), Act, 1986 registered at Police Station Khuian Sarwar, District Fazilka, Punjab (Annexure P-1).

As per facts of the case, prosecutrix 8SR9 aged about 29 years gave her statement that during the course of her studies, she came across Sonu Kamboj. They started talking to each other on phone. In November, 2024 while she was waiting for the bus at bus stop Sonu Kamboj came in his swift car. Since he was known to her, she sat with him. On the way he clicked her photographs. By threatening to viral her photographs he

-2committed rape with her in the car. She was raped multiple times and was taken to Grand Hotel, Malout. He also prepared a video. He continuously threatened her. Finally, matter is reported to the police. 3.

Learned counsel representing petitioner pointed out that allegations levelled against him are false. Petitioner is behind the bars since 20.01.2025. Petitioner and the prosecutrix belonged to same community and they were known to each other. They were having family relations. He helped to continue with her studies. In April, 2024, complainant got engaged and he stopped giving her money since she was getting married and had completed her studies. She again demanded money from him and when he refused, this false FIR has been lodged to extract money. DNA report (Annexure P-2) is in negative and copy of MLR is Annexure P-3. Statements of alleged victim as PW1 and Krishna Rani as PW2 are recorded (Annexures P-5 and P-7 respectively). He has also annexed the screenshots of whatsapp chats (Annexure P-6). Trial in this case may take long time. He is ready to abide by the terms of bail order. Therefore, her regular bail petition may be allowed. 4.

Bail petition is opposed by learned counsel representing State assisted by counsel representing complainant. As per status report, petitioner is in judicial custody since 20.01.2025. Challan was presented on 05.04.2025. Charges are framed on 05.05.2025 and till date 9 prosecution witnesses have been examined. It is pointed out that petitioner is involved in other criminal cases as mentioned in para No.6 of the status report. There are serious allegations against the petitioner. Therefore, he is not entitled to be released on regular bail.

I have considered the arguments and have gone through the record. Earlier, petitioner had filed regular bail petition bearing CRM-M32579-2025 which was dismissed as withdrawn on 23.12.2025 (Annexure P-8). He again filed bail application before Additional Sessions Judge, Fast Track Special Court, Fazilka which is declined vide order dated 13.01.2026 (Annexure P-9). First bail application filed before that Court was already declined on 22.05.2025. Thereafter, second regular bail petition has been filed in this case. Trial in this case is going on. Till date 9 prosecution witnesses have been examined including the victim as PW1 and Krishna Rani as PW2. Their statements are Annexures P-5 and P-7 respectively. Other prosecution witnesses are yet to be examined.

Learned trial Court will appreciate the facts and the evidence on record at appropriate stage. Therefore, without expressing my mind on the merits of the case, regular bail petition filed by the petitioner Sonu Kamboj is allowed. He is ordered to be released on regular bail on furnishing bail bonds and surety bonds to the satisfaction of trial Court/Duty Judge concerned. 6.
