Appellant - Puran Singh, then aged 42 years, filed present appeal challenging the judgment of conviction and order of sentence dated 27.09.2004, passed by Ld. Judge, Special Court, Bathinda, in NDPS File No.23 of 15.03.2002, arising out of FIR No.221 of 15.11.2001, under Section 15 of the Narcotic Drugs and Psychotropic Substances act, 1985 (for brevity 'NDPS Act'), registered at Police Station Rampura, Distt. Bathinda. 2.
Accused-appellant was held guilty for commission of offence punishable under Section 15 of the NDPS Act, and was sentenced for a period of five years Rigorous Imprisonment (RI) and to pay a fine of Rs.5,000/-, and in default of payment of fine, further RI for three months. 3.
Today, again there is no representation on behalf of the appellant. However, learned State counsel, on instructions from ASI Sher Singh, has submitted that appellant - Puran Singh has already expired during the pendency of present appeal and produced copy of death certificate dated 29.12.2020, issued by the Office of Additional District Registrar (SMO), JAWALA RAM 2023.03.21 16:40 I attest to the accuracy and authenticity of this order/judgement.
2023:PHHC:041477 CRA-S-2237-SB-2004 - 2 - CHC Ballianwali. As per said death certificate, appellant expired on 22.12.2020. Photocopy of said death certificate is taken on record, subject to all just exceptions. Office to tag the same at appropriate place. 4.
Therefore, in view of the above noted circumstances, present appeal stands abated, and same is disposed of as such. However, it would be subject to the terms & conditions, passed by this Court in Shivji Ram @ Dimple Vs. State of Punjab, 2022 SCC Online P&H 3759 (Law Finder Doc Id # 2076392).
Appeal stands disposed of.
