The petitioner's application under Order IX Rule 13 of the Code of Civil Procedure, 1908 (hereinafter referred to as "CPC") to set aside the ex parte judgment and decree has been dismissed by both the Courts below.

It has been found that the petitioner was represented by Mr.Narinder Singh, Advocate. Subsequently, he engaged Mr. Himmat Singh, Advocate, who also did not appear. The judgment and decree passed in favour of the plaintiff is only an injunction against forcible dispossession. 3.

Though, the learned counsel representing the petitioner has made a sincere endeavour, however, failed to draw attention of this Court to any perversity or material error in the appreciation of evidence. 4.
