RAMENDRA JAIN, J. (ORAL) Present criminal appeal has been preferred by the appellant against judgment of conviction dated 04.11.2004 and order of sentence dated 06.11.2004 passed by learned Additional Sessions Judge (Adhoc), Fast Track Court, Kurukshetra, whereby appellant, in a case arising from FIR No.305 dated 05.07.1999 registered under Sections 120-B, 307 read with Section 34 IPC at Police Station City Thanesar, has been sentenced to undergo rigorous imprisonment for a period of six years and to pay a fine of ` 2000/- for an offence punishable under Section 307 read with Section 34 IPC besides sentencing him under Section 307 read with Section 120-B IPC. However, both the sentences have been ordered to run concurrently. 2.

Custody certificate filed in Court today is taken on record. However, as per office report and death certificate annexed therewith, appellant-Kashmir Singh @ Kala expired on 30.12.2008. 3.

Hence, this appeal stands abated on account of death of the appellant and, thus, disposed of as such.
