-.- JAISHREE THAKUR J. (ORAL) The instant petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.155 dated 04.11.2020 under Sections 379-B, 120-B, 411 IPC registered at Police Station Mukerian, District Hoshiarpur.

Counsel for the petitioner inter alia would contend that in fact the FIR was registered against three unknown persons and it is only after 22 days that the supplementary statement was recorded against three petitioners herein. It is argued that recoveries alleged to have been made from them are foisted. It is further argued that in fact no other case has been registered against the said petitioners, who are young boys, while further contending that the investigation is complete and the challan stands presented, therefore, custodial interrogation of the petitioner would no longer be required.

CRM-M No.5950 of 2021 (O&M) -2bail application by submitting that no ground for grant of bail to the petitioners is made out.

I have heard learned counsel for the parties. Keeping in view the fact that the investigation is complete and the challan stands presented and the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
