**** HARNARESH SINGH GILL, J.(Oral) Prayer in this petition is for issuance of a writ in the nature of Mandamus directing the respondents to grant deemed promotion to the petitioner to the post of Lecturer in Economics w.e.f. 16.12.1997 and further to the post of Principal w.e.f. 04.08.2021, the dates on which his junior-respondent No.4 was promoted.

Learned counsel for the petitioner submits that since respondent No.4, namely, Raj Pal, has since retired on 31.05.2022, he does not press this petition qua him and his service may be dispensed with.

Ordered accordingly.

Learned counsel for the petitioner further submits that the petitioner is going to retire on 30.09.2023 and that though there is nothing adverse against him, the claim of the petitioner has arbitrarily been denied.

CWP-1951-2023 (O&M) -2At this stage, learned counsel for the petitioner submits that for redressal of his grievances, the petitioner has served a legal notice dated 26.11.2022 (Annexure P-27), but the same has not been decided till date. He confines his argument to the extent that the respondents be directed to decide the said legal notice in a time bound manner. Learned State counsel submits that he has no objection if the aforesaid limited prayer made by the learned counsel for the petitioner, is allowed.

In view of the above, the present petition is disposed of with a direction to respondent No.2-Director General, Ddepartment of Secondary Education, Haryana, to decide legal notice dated 26.11.2022 (Annexure P-27) moved by the petitioner, within a period of four weeks from the receipt of the certified copy of this order, by passing a speaking order, as per law.
