Learned counsel for the petitioners mainly submitted that vide order 09.12.2015, evidence of petitioners/defendants was closed by Court order. Resultantly, the petitioners could not complete the cross-examination of PW-4 Jagdish Parshad, who is husband of the plaintiff and the material witness.
Learned counsel for the petitioners further submits that the respondent was given unreasonable adjournments during the trial of the case and if the petitioners be given one opportunity for the purpose, they shall complete the cross-examination.
In view of fact, rather than giving notice to the opposite party, the impugned order dated 09.12.2015 is set aside and the petitioners are given one adjournment for the purpose of conducting cross-examination of PW-4 Jagdish Parshad. However, that adjournment is subject to the payment of costs of `5,000/-.
Present petition stands disposed of.
