-.- AMIT RAWAL J. (ORAL) Mr. Rajan Bansal, learned counsel appearing for the respondents has brought to the notice of this court that the suit is at the fag end of the trial.
Confronted with such situation, Mr. Sethi, on instruction from his client, wants to withdraw the application moved under Order 7 Rule 10 CPC, which has been returned owing to want of territorial jurisdiction, however, direction may be given to dispose of the suit as expeditiously as possible and decide the objections in case evidence is led on that point.
In my view, the aforementioned prayer is most innocuous and cannot be said to be adverse to other side. Resultantly, the revision petition is disposed of with direction to the trial Court to decide the suit as expeditiously as possible after taking into consideration all the legal objections taken by the petitioner-defendant in accordance with law.
