The issues are framed on the basis of pleadings and not vicea-versa. If there is an issue framed by the trial Court whether the defendant had prescribed title to the property by adverse possession, there cannot a situation that the defendant should be permitted to bring a statement that he has title to the property by way of adverse possession. Ths amendment was sought after the stage of remand at the trial. The trial Court has rejected it.
