In the High Court of Punjab and Haryana, at Chandigarh Civil Writ Petition No. 2580 of 2023 Date of Decision: 08.02.2023 Rajesh Kumar ... Petitioner(s)
Versus
State of Punjab and Others ... Respondent(s) CORAM: Hon'ble Mr. Justice Anil Kshetarpal.
Present:

Mr. Vishnav Gandhi, Deputy Advocate General, Punjab, for the respondents.

1.
The petitioner, on attaining the age of superannuation, retired as a Sub Divisional Officer. He assails the correctness of the recovery of an amount of ₹1,44,806/-.
2.
The learned counsel representing the petitioner admits that the order of recovery was passed on 12.11.2002. The learned counsel submits that the aforesaid amount has been deducted in the year 2021. 3.
On reading of the letter dated 18.02.2021, it is evident that the recovery of ₹1,44,806/- is already deducted from the arrears of 14 years of the employee.
4.
In any case, the petitioner, through this writ petition, prays for refund of the aforesaid amount. The recovery has been made pursuant to the order passed in the year 2002. Hence, it would not be appropriate to entertain a writ petition after a period of 22 years. Consequently, the present DEEPAK KUMAR BHARDWAJ 2023.02.10 11:07 I attest to the accuracy and integrity of this document
Civil Writ Petition No. 2580 of 2023 writ petition is dismissed. The petitioner, if so advised, may avail the alternative remedy.
