This matter is being taken up for hearing through video conferencing due to outbreak of the pandemic, COVID-19.



 

     This order shall dispose of abovenoted CWP Nos.3094, 13189 and 8335 of 2021.

The petitioners in all the writ petitions are aggrieved of their candidature not being considered for the post of PTI, only on the ground of their official result being declared after the cut-of date i.e., 21.08.2006, whereas their confidential results were admittedly declared prior to the said date. The controversy in hand is squarely covered by the judgment of the Hon'ble Supreme Court in Haryana Staff Selection Commission v. Priyanka and others, 2021(4) SCT 80 wherein it is held that candidature cannot be ignored solely on the ground of the official result being declared after the stipulated cut-of date in the face of confidential result having been declared earlier.

Learned counsel for the State, on instructions from Mr. Dikansh Goyal, Legal Assistant, HSSC, submits that the candidature of Satwinder Singh (petitioner in CWP No.3094 of 2021), Anurag (petitioner No.2 in CWP No.13189 of 2021) and Pardeep Kumar (petitioner No.1 in CWP No.8335 of 2021) has since been recommended in January, 2022, whereas candidature of petitioner No.1-Neelam Rani and petitioner No.3-Pardeep Kumar in CWP No.13189 of 2021 as well as petitioner No.2-Jasbir Singh and petitioner No.3Rahul in CWP No.8335 of 2021 is under consideration of the authorities. Necessary action shall be taken in accordance with law. Therefore, the present writ petitions have been rendered infructuous. Learned counsel for the petitioners is unable to deny the same. In this view of the matter, all the writ petitions are disposed of as infructuous.



 

    Needless to say, consideration of the candidature of Neelam Rani, Pardeep Kumar (petitioners No.1 and 3 in CWP No.13189 of 2021), Jasbir Singh and Rahul (petitioners No.2 and 3 in CWP No.8335 of 2021) be carried out expeditiously. In case they are found eligible, necessary action be taken in accordance with law.
