Mr. Deepak Grover, Advocate, for the petitioners. GURVINDER SINGH GILL, J. (Oral) The petitioners assail order dated 05.10.2023 (Annexure P2) vide which they have been declared 'proclaimed person'. Having heard learned counsel for the petitioners, this Court does not find any infirmity in the impugned order dated 05.10.2023. Learned counsel for the petitioners could not point out any patent illegality in the procedure adopted by the Court concerned. The petitioners had absented from the Court proceedings on 13.11.2018 constraining the trial Court to issue non-bailable warrants. Thereafter, since the presence of the petitioners could not be secured, they were ultimately declared 'proclaimed person' vide impugned order dated 05.10.2023. Under these circumstances, no illegality having been shown to this Court, the impugned order dated 05.10.2023 is upheld. However, in case, the petitioners surrender before the trial Court within 10 days from today and move an application for grant of VIMAL KUMAR 2024.04.22 18:57 I attest to the accuracy and integrity of this document
CRM-M-5134-2024 -2regular bail, the trial Court shall endeavour to dispose of the same expeditiously, preferably within a period of less than a week from filing of such application.
Petition stands disposed of accordingly.
